租住房屋 Renting A House置業安居是人生大事,故此許多新移民在投入加國生活初期,不會貿然作出買屋決定,於是便得先租住房屋,待熟識環境以後,才考慮購置樓房。

租客保障法 Tenant Protection Act安省租客保障法明文規定業主及租客各自享有的權利和應盡的責任,其適用之樓房物業,包括﹕柏文、鎮屋、房屋及流動屋(Mobile House)﹔「根據租客保障條例,無論業主住客均不能擅自推翻彼此之間所訂立之口頭或書面協議。住客一旦遷入租住單位,其權利即受法例保障。雖然租約可以口頭或書面約定,但以書面協議之保障為佳。」私隱權條例租客除受租客保障法保護外,其私隱權還亦會受到法律的保障。業主未得租客同意,不得擅自進入其已出租物業﹔若有需要,須於24小時之前以書面通知租客,並寫明進入單位之目的及時間,及獲得租客同意,方可入內。不過,在緊急情況之下,以上規定暫不適用。

預繳按金一般業主會要求租客遷入出租物業之前,繳付首月及最後一月租金,後者可視作按金,住客可要求業主在持有按金期間,按銀行存款利率計算,支付按金利息。

提早終止租約租約期限未滿,而業主住客任何一方欲提前終止,都必須雙方同意,才可以避免爭執﹔否則,問題將難以解決。不過,雙方都有一些常規可以遵循。租客若想提早終止租約,應及早通知業主﹔如若業主拒絕要求,租客可另覓租戶,並要求更改租約上租客名字,否則仍須履行租約。租客如果一走了之,業主有權追討租約未付租金。業主若要提早終止租約,收回物業,亦須徵得住客同意,否則要交由法庭裁決。

下面是一些業主提出,而法庭又比較容易接受的提早終止租約理由﹕租客故意或疏忽損毀租用單位﹔租客滋擾他人,包括其他租客或業主﹔租戶居住人數太多,導致居所過份擠迫﹔租客行為怪異,影響他人安全﹔租客利用租住單位進行非法活動。

租期屆滿租約期滿,新約尚未達成,租客仍可照舊約租住單位或無需提出理由而遷走﹔但業主若要租客遷走,則必須有充分理由及以書面通知租客,不能以租約期滿為理由,要租客覓地他遷。一般業主不予續約的理由如下﹕收回出租單位自用,包括供業主父母、子女居住﹔租客經常遲交或欠繳租金﹔租客租住單位由僱主提供,而租客之僱佣合約期滿。租賃房屋審裁安省設有租賃房屋審裁處(Ontario Rental Housing Tribunal),負責仲裁一切租賃房屋問題,無論業主住客,遇有租務問題,可往尋求協助。電話號碼﹕1-888-332-3234,416-645-8080互聯網址﹕ www.orht.gov.on.ca

房屋保險自住房屋為一般家庭最重要資產項目,多數會購買保險以策安全﹔若房屋需要向銀行按揭貸款,則更須呈示保險證明,才會得到批准落實。

房屋保險種類較多,不過一般業主多數購買其中兩類,就是基本保險或全保。基本保險只是投保房屋及指定項目﹔全保則包括房屋、屋內財物及第三者保險。

保費方面,基本上按照樓房屋重建費用而定,考慮的因素是樓齡、面積、建築材料、設備等﹔若房屋用料特別或設備新奇,則投保前宜委託專業樓房估價員為物業評估價值,然後決定保額。保費方面,自住房屋保費較低﹔出租或分租則會被調高。

投保房屋若改變用途,須立即通知保險公司,否則一旦有事故發生,保險公司會以房屋用途與保單所列並不相符,拒絕賠償。

加拿大置業安居 - 樓房按揭分期付款

樓房按揭不少置業人士喜歡採用分期付款方式繳付屋價,這樓便需要到銀行辦理預先批准按揭。
銀行會根據申請人的經濟情況,銀行存款及信用紀錄,擬定「預先批准按揭書」,使申請人知道獲批的最高貸款限額、利率及按次還款數目。其中按揭利率的有效期,是由簽署「預先批准按揭書」當日起計60至90日,視乎個別銀行而定,期內即使按揭利率上升,申請人仍可按照原有簽定履行合約﹔惟若利率下降,則申請人可享用較低之利率。

安省一般樓房買賣,多數透過經紀進行,雖然經紀費用需由賣家支付,但卻可以享受他們具備的專業知識及服務,免卻許多麻煩周折,甚至因小失大。經紀佣金比率平均為6%,由買賣雙方經紀對分。亦有小部份業主自行出售房屋物業,雖然可以省掉經紀佣金,但是卻必須用心費神,處理種種交易細節,尤其議價、訂立合約、繳付訂金以及有關法律問題。無論委託經紀,抑或自行買賣,將買賣契約交律師審閱是必須步驟。除非您對契約內容完全了解,否則不應貿然簽署。因為契約一經簽署,便成為有效法律文件。

簽約前交律師審核,作出適當的修訂,才可以確保自己的權益。當然,如果您擁有一些樓房買賣的基本法律知識,出錯的機會亦會相對減少。比如業權的調查,責任落在買方律師,所以買賣合約上須有查契日期,買方律師若在查契時發覺業權有問題,必須在查契日期內提出修正要求,故此,一般將該段日期定為30日。

重售樓房就要預備有效的測量圖則,以能清楚顯示樓房地段及外牆線、所有建築物及籬笆,和有測量師姓名、簽署及日期為合。律師取得圖則後,方可調查房屋是否符合法例、地段尺寸是否與買賣合約相符,甚或是否有「違例建築」等等。
此外,在物業交吉期間,買方如有遠行,出發前須通知律師,並準備授權書,交託授權人處理有關文件及事宜。

繳付訂金買賣雙方簽署協議書後,買方便須繳付訂金。訂金數目並無明文規定,亦視乎物業類型而異。預售樓花,按個別發展商要求而定,一般為屋價的10%至15%﹔重售樓房,訂金則由買賣雙方議定,應以雙方滿意為標準。

繳付訂金之後,若要改變決定,亦有政府規定可以依循。買賣物業如屬共管式樓房,規定有10日「冷靜期」,期內買方欲撤消交易,取回訂金,可以無需提出理由及負上任何責任。然而,上述法例並不適用於非共管式的新屋或重售住宅物業﹔即使買家放棄訂金,仍然對所訂契約負有法律責任,發展商或賣方依然有權向買方追討損失或賠償。
買方也可以在買賣契約中,要求列明有權退訂條款﹔常用的條款是買方要獲得銀行貸款、滿意驗樓報告或成功出售現有物業才履行合約,否則有權取消交易。

樓房檢驗無論購置新舊樓房,最好還是聘請專業驗樓師進行詳細檢驗,確保安全。不過,安省政府並未規定房屋檢查員需領有牌照,故此聘用之時務須小心為上。目前為大多市提供驗樓服務的人士,主要類別計有﹕安省專業註冊工程師、註冊建築師、特許測計師、加拿大房屋按揭公司 (CMHC)督察、安省新屋保障計劃(ONWHP)督察及建築商等,前三者的服務水平有專業協會監管,故而可靠程度亦較高。部份驗樓師使用美加驗樓師專業學會驗樓表格,例如﹕美國驗樓師學社(America Society of Home Inspectors, ASHI)屬會驗樓表格,或加拿大省會專業驗樓師學會(Provincial Association of Certified Home Inspector, PACHI)表格,驗樓報告較為全面及可靠。至於檢驗的項目,新屋注重樓房是否按照合約的圖則、材料及款式建成﹔舊樓還要兼顧樓房結構是否安全,甚至內牆是否有蟲蟻為患。若發現任何問題,可以在收樓之前,要求改善。

置業優惠安省政府目前設有5項鼓勵省民置業安居的優惠措施:

第一項:5%首期計劃是由加拿大按揭及房屋公司(CMHC)提供的房屋貸款保險計劃,合資格獲該公司貸款的置業人士,物業按揭額可高達其價格的九成半,業主只需支付5%的首期。但每月供款不能超過每月收入的32%﹐貸款的最長年期為25年﹐申請人需要證明自己有能力支付通常約屋價1.5%的成交費(Closing Costs)。查詢電話﹕1-800-668-2642網址﹕http://www.cmhc/

第二項:RRSP購房者計劃是置業人士可以從註冊退休儲蓄計劃(RRSP)中,提取$20,000作為首期之用,夫婦二人提取款項甚至可以高達$40,000﹔提取之款項可以分15年攤還。

第三項:土地轉讓稅回扣按省府頒布的措施,土地轉讓稅(Land Transfer Tax)退款額為$2,000﹔即購買屋價在$227,500以內之新建樓房自住之業主,可獲100%的退稅,如屋價較高者,則須繳付退款之差額。惟欲享受此項退稅之新樓房業主,必須符合以下條件﹕年齡在18歲或以上﹔從未在世界上任何地方擁有物業,而其配偶與置業者共同生活期間,亦從未擁有物業﹔購入之新樓房必須為業主之主要居所。

第四項:GST新屋回扣向建築商購買全新或完全翻新過的房屋、自己建造一間房屋或進行大幅度的裝修、大型加建工程、房屋於火災後重建等﹐均可獲得GST部份回扣。如果房屋GST稅前價格在$350,000或以下﹐買家所付6%GST中﹐可申請退回36%﹐最高至$7,500﹔新屋價格在$350,001至$450,000﹐回扣率會按比例遞減﹔$450,001以以上的房屋﹐不能申請這項回扣。

第五項﹕CMHC買房及改進工程計劃該計劃讓買房者可以一次性借到足夠作買房及裝修用途的費用。申請人必須有借貸總數的5%作為按金﹐而且要有固定收入。

樓房格式安省居住物業建築格式,主要為樓房與柏文大廈﹕

平房 (Bungalow)房屋地段較為闊大,屋齡亦較高,單層建築,起居室及設施大部份集中在一層之內,而且多數是舊屋。
獨立屋 (Detached House)在一個地段上建築的唯一樓房,對地段有擁有權,與鄰舍距離亦比較遠,在全國數量亦最多。
半獨立屋 (Semi-Detached House)兩套房子共用一個屋頂,中間只有一道牆壁加以隔開。
連屋 (Link House)兩座房屋部份相連,如車房與土庫﹔部份則僅在地面上以三合土相連,實質上與獨立屋無異。
鎮屋 (Town House)三間或以上房屋並列興建,面積通常較獨立屋為小,屋形較長,價格亦較相宜。
柏文 (Apartment)實際上是多層住宅大廈,在地廣人稀的加拿大數量比較少,出現也比較遲,而且多數集中在市中心。

早期柏文層樓及單位均不多,亦大多以出租為主。從七十年代開始,柏文以分契(Condominium)方式出售﹔
九十年代以來,這種柏文出售的方式廣受歡迎,交易亦逐年遞增。物業所有權普遍而言,平房、獨立屋、半獨立屋及連屋業權由業主擁有,包括房屋以至土地﹔
鎮屋及柏文則分為共同擁有式 (Condominium)或全屋契式。全屋契式與獨立屋業權無異,業主完全擁有樓房及土地﹔
共同擁有式則與個別出售柏文單位一樣,個別樓房或單位為業主所擁有,其他公共地方則為個別單位業主所共有。因此,業主會組成立案法團負責議定決策,而日常事務則委託管理公司代辦,故而業主每月要交管理費,用以支付公眾地方管理與維修之費用。

選購樓房 Buying A Home營造安樂窩是每個家庭最重視的事情,在進行的過程當中,需要尋找的資料以及考慮的問題非常多,比如﹕樓房的所在地區、建築方式、面積大小、屋齡長短、價格高低、環境交通等等,實在費煞思量。所以,歸根究底,必然需要掌握一些可以幫助您作出抉擇的資料。物業類型省內一般出售物業,大致上可以劃分為三種類型﹕現有落成新物業、預訂樓盤及重售單位。現有落成之新物業,經已完成建築實體,只要買賣雙方達成交易契約,業主就可以入住新屋,只是這類出售樓房數目不多,選擇受到限制。預訂樓盤,即所謂「買樓花」,是先交訂金,待預訂樓房建築完成,然後貨銀兩訖。一般發展商為加強買家信心,多數在樓房建築地盤陳列示範單位,以供參觀選購。惟因訂購樓房實際尚未興建或完成,故買家需有心理準備,或者會因為已知或未能預測因素,影響入伙日期。
以上兩種新購樓房,全部業主均受到強制性的安省新屋保險計劃 (Ontario New Home Warranty Program, ONHWP)的保護,新落成的樓房,主要結構有7年的保障。所以每個新樓房單位均須向安省新屋保障計劃辦事處進行登記,繳交按樓價計算之登記費用,然後獲配單位編號。實際運作則是建築商早在樓房動工之前,業已繳交有關費用。
計劃保障,包括各種類型的新樓房,惟獨近年在物業市場上出售,由商廈改變為住宅用途的「新樓」並不入保障之列。
計劃受保範圍,隨樓齡增長而縮減。新屋入伙的第一年屬全保﹔入伙後第二年,受保範圍便開始縮小,受保項目計有﹕地庫、地基或柏文地下停車場滲水﹔電力、水管、暖氣運作出現問題﹔外牆破裂或嚴重損壞,以及觸犯安省建築規例健康及安全條款等。入伙後的5至7年,受保障的就只是樓宇的主要結構缺陷,即是樓房會因結構承受重力受損的物料或手工有缺陷,以致嚴重影響其作為居住用途而已。

從加拿大境外郵寄物品進來,可以免關稅的物品是:

*價值60元及以下的禮品﹐這些物品應該有明確的票據證明其確實屬於禮品範疇。價值超過60元的那一部份必須按規定交納關稅。

- 價值在20元及以下的物品免交關稅。- 煙、酒、書籍、期刊、雜誌及廣告品不屬於上述免稅物品範圍。- 在加拿大境內訂購﹐但由境外郵寄的物品也必須交關稅。
